Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Supportal application and website (the “Service”), operated by Dennis Kooij (ABN 16 273 117 835) (“Supportal”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Supportal is a workflow tool that helps Australian sole-trader support workers manage shifts, shift notes, clients, invoices, expenses, and related records. We may add, change, or remove features from time to time.

2. Eligibility

You must be at least 18 years old and use the Service for your business or professional purposes. By using the Service you confirm that the information you provide about yourself is accurate and that you have authority to enter into these Terms.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorised use. You must provide accurate account information and keep it up to date.

You can cancel your subscription at any time. Cancellation stops future renewals. If you have already been charged for the current month, see “Refunds” below. You can export all of your data before or after cancelling using the in-app backup feature.

6. Refunds

You can cancel your subscription at any time. If you have been charged for the current month, you can request a full refund for that month by emailing us at contact@supportalapp.com. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

You retain ownership of the data you enter (“Your Content”). You grant us a limited licence to host, store, process, and transmit Your Content solely to provide the Service to you.

Participant information. You are solely responsible for the information you record about the people you support, including having a lawful basis and any necessary consent to collect, store, and use it, and for handling it in accordance with the Privacy Act 1988 (Cth) and any NDIS obligations that apply to you. You are responsible for the accuracy of invoices, notes, and records you create.

9. Not professional advice

Important. Supportal is a record-keeping and workflow tool only. Any figures it produces — including tax estimates, GST, superannuation set-asides, kilometre deductions, NDIS line items, and invoice totals — are estimates and general information, not financial, accounting, taxation, legal, or NDIS-compliance advice. You are responsible for verifying all figures and for meeting your own tax, invoicing, and NDIS obligations. Seek advice from a qualified professional (such as a registered tax agent or accountant) before relying on them.

10. Intellectual property

The Service, including its software, design, and branding, is owned by Supportal and its licensors and is protected by law. These Terms do not transfer any of our intellectual property to you.

11. Third-party services

The Service integrates with third parties (for example Stripe for payments, and optionally Google Calendar and address-lookup providers). Your use of those features may be subject to the third party’s own terms. We are not responsible for third-party services.

12. Availability and warranties

We aim to keep the Service available and reliable, but it is provided “as is” and “as available”. To the maximum extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. This clause does not exclude any guarantee that cannot be excluded under the Australian Consumer Law.

13. Limitation of liability

To the maximum extent permitted by law, Supportal will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or goodwill. Where our liability cannot be excluded, it is limited (at our option) to resupplying the Service or paying the cost of resupply, or to the amount you paid us in the 12 months before the event giving rise to the liability, whichever is greater. You remain responsible for keeping your own backups using the in-app export feature.

14. Indemnity

You agree to indemnify us against claims, losses, and costs arising from your breach of these Terms, your misuse of the Service, or your handling of participant information.

15. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

16. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if we reasonably believe your use poses a risk. On termination, your right to use the Service ends; you may export your data beforehand, and we will handle any remaining data as described in the Privacy Policy.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the app. Continued use after a change means you accept the updated Terms.

These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.
